In a significant ruling, the Orissa High Court awarded ₹5 lakh compensation to a 47-year-old man whose claim for a railway job was rendered invalid due to prolonged litigation.
A division bench comprising Justices Krishna Shripad Dixit and Chittaranjan Dash observed that the petitioner had crossed the age limit during the course of the legal battle, making employment no longer feasible. However, the delay was not attributable to him, warranting monetary relief.
Invoking principles of equity, the court emphasized that systemic delays should not deprive individuals of legitimate opportunities. It directed authorities to pay the compensation within eight weeks, warning of penalties in case of non-compliance.
The case dates back to 2009, when the petitioner sought a Group D job under the discretionary quota of East Coast Railway in Sambalpur. His application was rejected in 2012 due to higher qualifications and policy changes.
After multiple rounds of litigation, including proceedings before the Central Administrative Tribunal Cuttack Bench, the matter ultimately returned to the High Court, which delivered the final verdict awarding compensation.
The ruling highlights the adverse impact of prolonged legal proceedings on employment claims and reinforces the judiciary’s role in ensuring equitable justice.
