Delhi High Court Says Homemaker’s Work Is Valuable, Rejects ‘Idle Wife’ Argument in Maintenance Case

Delhi High Court ruled that a homemaker cannot be called “idle” and her domestic work must be recognised while deciding maintenance. The court granted ₹50,000 maintenance to an estranged wife, stressing unpaid household labour has economic value.

The Delhi High Court has strongly rejected the notion that a non-earning wife can be considered “idle,” emphasizing that homemakers perform essential labour that supports the family and enables the earning spouse to succeed professionally.

Justice Swarana Kanta Sharma observed that domestic responsibilities such as managing the household, caring for children, and supporting the spouse are forms of unpaid labour that carry significant economic value. The court said denying maintenance solely because a woman is educated and capable of earning reflects a flawed understanding of domestic contributions.

The observations came while hearing a maintenance plea filed under the Protection of Women from Domestic Violence Act. The lower courts had earlier denied interim maintenance, stating that the woman was well-educated and capable of working.

However, the High Court clarified that the capacity to earn and actual earnings are different, and maintenance cannot be denied merely because a woman is capable of employment. The court also noted that women often sacrifice careers for family responsibilities and may not be able to resume work at the same level later.

Finding no proof of independent income, the court awarded ₹50,000 as maintenance to the wife. It also highlighted the need for mediation instead of prolonged litigation in matrimonial disputes, stating it benefits both parties and their children.
