The Supreme Court of India has ruled that delay in the investigation or trial cannot automatically be used as a justification to secure bail in the Delhi riots cases. While recognizing the constitutional guarantees of personal liberty and the right to life, the Court emphasized that these rights are not “absolute” and can be subject to reasonable restrictions under special statutes, such as the Unlawful Activities (Prevention) Act (UAPA).
The bench reasoned that granting bail solely on the basis of procedural delay could undermine the objectives of laws designed to address serious crimes and maintain public order. The Court highlighted that bail applications must be considered on a case-by-case basis, taking into account factors such as the severity of the offense, evidence, and the risk of the accused influencing the investigation or committing further crimes.
This judgment underscores the principle that while speedy trials and procedural efficiency are important, they cannot automatically override statutory provisions meant to tackle terrorism, communal violence, or other serious offenses. The decision serves as a key precedent in balancing individual liberties with the state’s responsibility to ensure law and order in sensitive cases like the Delhi riots.
