Madras High Court Flags ‘Dangerous Trend’ After Censor Board Delays Jana Nayagan

The Madras High Court granted Jana Nayagan a U/A 16+ certificate and strongly criticised the CBFC for last-minute objections that delayed the film’s release. The court warned that such actions could undermine the credibility of the film certification process.

The Madras High Court has cleared Jana Nayagan, starring Vijay, with a U/A 16+ certificate, while sharply reprimanding the Central Board of Film Certification for what it described as a “dangerous trend” in the certification process.

The ruling came after the film’s release was stalled due to eleventh-hour objections raised by a CBFC Examining Committee member, despite the panel having already recommended certification with modifications. The delay forced the film’s producers to approach the court even as advance bookings were underway in India and overseas.

Court’s Strong Observations

Justice P.T. Asha noted that objections raised after a recommendation had already been made could not be allowed to derail the certification process.

“Such a volte-face by a member of an examining committee would give rise to a dangerous trend,” the court observed, warning that it could erode the sanctity and credibility of CBFC decisions.

The court further ruled that once the recommended cuts were implemented, the certificate should have followed automatically, stating that the CBFC chairperson’s decision to delay certification was “without jurisdiction.”

Relief for the Makers

The High Court ultimately directed the CBFC to issue the U/A 16+ certificate, clearing the way for the film’s theatrical release. Jana Nayagan had originally been scheduled to release on January 9, 2026, but the certification dispute led to a postponement.

According to the producers, the delay resulted in:

  • Nearly 2 lakh advance tickets already sold

  • Estimated losses of around ₹50 crore

Likely Pongal 2026 Release

Following the verdict, the makers are expected to announce a revised release date soon. Industry sources suggest the film may now target a Pongal 2026 release window, potentially around January 14.

The judgment is being seen as a significant reminder that individual dissent after formal certification recommendations cannot override established procedures, reinforcing the rule of law in film certification.
