The Orissa High Court has reinforced that a woman’s consent is essential in all marriage-related decisions, and parents or guardians must obtain her approval before proceeding.
The ruling came during a habeas corpus petition linked to a case from Kakatpur, where a father alleged his daughter had gone missing after marriage. While examining the matter, the Court strongly condemned forced or imposed marriages, emphasizing that pressuring a woman against her will is harmful to a healthy and progressive society.
The judges highlighted the importance of individual autonomy, noting that guardians imposing decisions on their children is a concerning mindset that needs correction. The Court also stressed that the administration has a role in creating awareness to prevent such practices and that the choices of an adult woman must be respected.
