The Orissa High Court has sought responses from the Odisha Transport Department and the State Transport Authority after allegations surfaced that PUC challans are being imposed at toll gates without mandatory pollution checks. The court issued notices after accepting a petition filed by Dr. Kirtidhara Das, who was fined тВ╣10,000 at the Pipili toll gate on grounds of an invalid PUC certificate.
The petition challenges the enforcement practice, arguing that fines are being imposed in violation of the Motor Vehicles (Amendment) Act, 2019. Under the Act, authorities are required to send prior notice to a vehicle owner if their PUC certificate has expired and may impose a fine only if the vehicle is found to be polluting during inspection.
The petitioner’s lawyer, Sahasranshu Sourav, stated that issuing challans without physical verification or notice is arbitrary and illegal. The High Court has directed the authorities to submit a detailed explanation within 15 days outlining the procedures followed while issuing pollution-related challans. The matter is scheduled for further hearing on the 30th of this month.
The case has raised broader concerns over the enforcement of pollution norms and the legality of issuing fines at toll gates without proper verification, prompting public debate and legal scrutiny.
